Visitor Material

Other than personally identifiable information, which is covered under our Privacy Policy any communications, photographs, contributions, content, ideas or other material you submit, transmit or post to the Website (“Visitor Material”) shall be considered non-confidential and non-proprietary.

Scottish Open for The Icelandic Horse shall have no obligations with respect to such Visitor Material and you hereby grant Scottish Open for The Icelandic Horse a perpetual, irrevocable, royalty-free, non-exclusive sub licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights with respect to your Visitor Material worldwide and/or to incorporate your Visitor Material in other works in any media now known or later developed to the full term of any rights that may exist in your Visitor Material without payment or compensation to you. This includes the right to publish the Visitor Material on the Website.

Unless you specifically state otherwise when submitting your Visitor Material:

You hereby waive any moral rights in your Visitor Material for the purposes of its submission to and publication on the Website and the other purposes specified above;

You agree that Scottish Open for The Icelandic Horse may but is not obliged to include your name and other personal details in conjunction with the Visitor Material and its use;

You warrant and represent in relation to your Visitor Material:

• It is your own original work and that you have the right to make it available to Scottish Open for The Icelandic Horse for all purposes and to grant the rights and licences referred to above;
• That you have taken all possible care to ensure that your Visitor Material will not attract any complaint.
• You remain responsible and liable for the Visitor Material you submit and you hereby indemnify Scottish Open for The Icelandic Horse against all liabilities, claims, damages, costs and other expenses (including reasonable legal fees and expenses) that may be incurred by Scottish Open for The Icelandic Horse as a result of any breach of the terms relating to your Visitor Material.
• If you do not wish to grant these rights, please do not submit your Visitor Material.
• Scottish Open for The Icelandic Horse may choose to publish or otherwise use or not any Visitor Material you submit and Scottish Open for The Icelandic Horse will exercise its rights in relation to such Visitor Material in its absolute discretion. If Scottish Open for The Icelandic Horse decides not to use the Visitor Material, Scottish Open for The Icelandic Horse will delete such Visitor Material within 28 days from submission. Scottish Open for The Icelandic Horse reserves the right to remove from the Website at any time and without giving reasons or notice any Visitor Material you have submitted.
• If you are under 16, you must get a parent or guardian’s permission before submitting any Visitor Material.
